Businessman may be sentenced next month for corrupt practices

TERRE HAUTE — A Terre Haute businessman charged last year with corrupt business influence is expected to be sentenced next month in Vigo Superior Court 3.

Thomas D. Guess Jr., 59, appeared in court Monday with defense attorney Jessie Cook, who said that a plea agreement has been worked out with the county prosecutor’s office, but it must be put in writing. She asked that the trial date of July 22 be vacated by the court, and a date set for the change of plea hearing and sentencing.

Judge David Bolk set an Aug. 5 hearing date in the case, and ordered that a pre-sentence report be prepared before sentencing.

Guess was arrested in January 2012 after warrants were served at his home and his business, Northside Recycling, 1439 Ash St., a company that buys scrap metals and iron for resale to material processors.

The Vigo County Sheriff’s Department was tipped off to allegedly illegal activity at the business, so an investigation was developed using confidential informants who went to the business to attempt to sell stolen items, precious metal, scrap metal, copper wire and electronics and tools.

Guess was charged with two counts of corrupt business influence, a class-C felony, which is punishable by two to eight years in prison, and seven counts of receiving stolen property, a class-D felony punishable by six months to three years in prison.
