Terre Haute man facing 6 charges after Wednesday incident

TERRE HAUTE — A Terre Haute man faces six criminal charges after he allegedly tried to run over another man who intervened in a domestic altercation.

Clayton Miller, 36, appeared via video in Vigo Superior Court 5 on Wednesday where Senior Judge Barbara Brugnaux found probable cause for his arrest on charges of battery by means of a deadly weapon, criminal recklessness with a vehicle, leaving the scene of an accident resulting in injury, driving while intoxicated, domestic battery, and false informing.

Detective Starla Neidigh of the Terre Haute Police Department reported that at 3:30 a.m. Wednesday, police were called to a hit-and-run incident in the vicinity of the Sixth Avenue Gentleman’s Club after a person called Central Dispatch to report that he was following a Dodge pickup truck that had struck a pedestrian.

Police located the truck northbound on Third Street and stopped it at the overpass between Sycamore and Locust streets. Officers found that Clayton Miller was a passenger in the truck, but his wife was the driver, Neidigh said. However, multiple witnesses reported that Clayton Miller was the driver of the truck when it struck and injured the victim, who was later treated at Union Hospital in Terre Haute and released.

A witness told police that he and the victim were outdoors when they saw Miller allegedly being physical with a woman. The victim confronted Miller about his actions, Neidigh said. The witness said that a short time later, he and the victim heard a truck engine rev and come toward them, with the victim being struck and reporting leg injuries. The truck left the scene.

Police report that when the truck was stopped, Miller’s wife was “scared and reluctant to tell what happened” or say how she came to be in the driver’s seat of the truck, the detective said. The woman was released by police.

Inside the truck, police found a handgun. Miller also had a 0.22 percent blood-alcohol content when arrested.

Neidigh said that Miller has a criminal history in Illinois that includes an alcohol-related offense.

Judge Brugnaux ordered Miller held with bail set at $50,000 cash only. He is to return to court Monday for the filing of formal charges.
