September trial for man accused of killing brother

TERRE HAUTE — A man accused of killing his brother is now scheduled for trial in September.

Byron Sutton, 47, of Terre Haute, has a first-place trial setting Sept. 9 in Vigo Superior Court 5. He had been scheduled to go on trial Tuesday, but a defense attorney’s request for a continuance was granted by Judge Michael Rader.

Sutton was arrested in October 2012 after his DNA was found on the revolver recovered from the dead man’s apartment. Sutton alleged killed his older brother, Guy Sutton, whose decomposing remains were discovered in March inside his own Dreiser Square apartment.

Byron Sutton was charged with murder, and with failure to give notice of violent or suspicious death, a class-D felony.

Guy Sutton died of a single gunshot wound to the head, an autopsy revealed. His decomposing remains were found after maintenance employees opened the apartment to clean it because the tenant had failed to pay rent for two months.

During the investigation into the death of Guy Sutton, who was a double amputee, police found a large amount of blood on a couch in the apartment, along with a handgun.

Byron Sutton is being held in the Vigo County Jail without bond.
