Testimony to begin this afternoon in William Mallory murder trial

TERRE HAUTE — A jury has been seated in the murder trial of William Mallory, accused in a 2012 fatal shooting near the Ballyhoo Tavern just off the Indiana State University campus.

Seven women and five men, along with two alternates, were selected this morning to hear the Vigo Superior Court 6 case against Mallory. Opening arguments in the case will begin after a lunch break. Deputy Prosecutor Chris Wrede told the Tribune-Star that he plans to call two witnesses to testify this afternoon.

The trial is expected to continue to Friday.

Security inside the Vigo County Courthouse - and on the grounds around the courthouse and city hall - has been increased, with uniformed deputies located on all levels of the courthouse and outside the building. Additional metal detectors are being set up outside the courtroom doors as an additional precaution to screen the public entering to observe the trial proceedings.

Mallory is accused in the Aug. 24, 2012, fatal shooting of Dustin Kelly of Terre Haute. Two other men, Dante Pettus and Terrance Trotter, were injured in the shooting.

Mallory was charged with felony murder, two counts of class-A felony attempted murder, two counts of class-B felony aggravated battery, and carrying a handgun without a license, a class-A misdemeanor. Mallory allegedly shot all three men with a Smith and Wesson 9-millimeter handgun.

Trotter was shot in the hip, while Pettus was shot in the torso.
