Update: Arrest made in Terre Haute man’s death

---- — PALM BEACH GARDENS, Fla. — An arrest has been made in the Florida shooting death of a 24-year-old Terre Haute man.

Jay-Von Damoir Avery, 21, was arrested Saturday on a first-degree murder charge in connection with the death of Kyle Lutes, a 2008 graduate of Terre Haute South Vigo High School.

Avery appeared in Palm Beach County court on Sunday where he was ordered held without bail. A speedy trial date was set for Aug. 9.

The decomposing body of Lutes was found Feb. 8 by a man walking his dog near The Gardens Mall in Palm Beach Gardens.

WPTV Channel 5 in Florida reports that police stated the Lutes was shot in the back of the head and his body was dumped in a wooded area.

Avery has a criminal history that includes a 2007 arrest for robbery, according to court records.
