Bond set for man charged in attempted murder case

TERRE HAUTE — Bond has been set for a Brazil man charged with attempted murder in a July 2 shooting in Fontanet.

Brent Cooley, 46, appeared in Vigo Superior Court 1 on Friday where Judge John Roach set bond at $150,000 with 10 percent allowed. Cooley had previously been held in the Vigo County Jail without bond. He posted bond on Friday.

Defense attorney Ed McGlone asked for a bond of $75,000 with 10 percent allowed to be set, which would be a similar bond for a class-A felony case. The charge of attempted murder is to be refiled as a class-A felony. It was originally filed as murder, which would have no bond.

Cooley, who appeared in court in a wheelchair, testified that he was disabled by a workplace injury in 2005. He resides in rural Vigo County, even though he has a Brazil address. He testified that he seldom leaves his home except to go to doctor appointments.

Deputy prosecutor Carroll Smeltzer stated that Cooley is a danger to the community and requested a significant bond of $200,000 with 10 percent allowed to be set. He stated that the gunshot fired by Cooley was only two-inches away from resulting in a murder case. The bullet grazed the cheek of the alleged victim.  Smeltzer also noted that Cooley pointed the gun at two other people before fleeing the scene in a pickup truck.

Roach ordered Cooley to be supervised by adult probation if he posts bond, and not to leave the county unless the trip is cleared by the probation department. He was also ordered to have no contact with the victim in the case, and to have no firearms in his home.

Cooley has a Dec. 9 trial date.
