Man accused in 4 Omaha slayings has jail trouble

Garcia gets in tussle with prison guards

OMAHA, Neb. — A Terre Haute resident accused of killing four people with ties to an Omaha medical school has been charged with assaulting jail guards as he awaits his Nebraska trial.

A Douglas County Sheriff’s Office report said Anthony Garcia, 40, kicked one guard and swung at another in an incident Friday. Garcia had been told to return to his cell. He objected, saying he needed more time to place a phone call to his attorneys.

Garcia was wearing injury-prevention restraints and a suicide-prevention blanket because he’d been placed on suicide and behavioral watch after a recent visit with his attorneys, the report said. Nonetheless, Garcia managed to kick one of the officers several times in the ribs. His swing at the other guard landed on one of the guard’s hands and arms.  

Garcia has pleaded not guilty to murder charges in the 2008 slayings of the 11-year-old son of Creighton University pathologist William Hunter and the family’s housekeeper, as well as the May deaths of Creighton pathologist Roger Brumback and his wife.

Brumback and Hunter had fired Garcia from the Creighton pathology program in 2001.

Prosecutors also have charged Garcia with burglary, saying forensic evidence linked him to an attempted break-in at the home of another Creighton University Medical School professor.

The run-in with guards wasn’t Garcia’s first. The sheriff’s report said Garcia has become belligerent and somewhat irrational.

In a separate incident last week, said Garcia’s attorney Alison Motta, a jailer sprayed a chemical on Garcia when he wouldn’t comply with jail policy.

In a letter Garcia wrote Friday to a federal judge, he objected to jail restrictions that included his being allowed only an hour a day to review books from the jail’s law library.

Garcia has also complained that he has no access to computers and that his phone calls are monitored.
